What can people expect to take away from your talk at Amafest 2019?

The general bases and exceptions for U.S. intellectual property infringement, how to navigate Amazon’s procedures to report an infringement, and how to escalate issues off the Amazon platform.

Can you tell us a little bit about your background? What experience do you have working with Amazon?

I am a managing attorney and partner at Rosenbaum Famularo, P.C., the law firm behind Amazon Sellers’ Lawyer (ASL). I have been with ASL since its inception. We focus every day on both reporting and appealing intellectual property and other Amazon complaints.

What’s your top tip for someone who’s thinking about selling on Amazon?

Do some research on potential IP issues before launching a new product. If you identify any potential issues, hire someone to get a formal opinion before proceeding. Know your own risk tolerance.

Do you think Amazon is a threat to traditional brick and mortar retail?

No, we have seen the retail experience for traditional brick and mortar evolve, and I think it will continue to do so.

What are the main benefits of selling products on Amazon as opposed to other platforms such as eBay?

Instant exposure to the majority share of the eCommerce industry.

In 2016 the amount of sellers using Fulfillment by Amazon rose by more than 70%, but what’s your opinion? Do you think it’s worthwhile?

While there are different concerns for brand owners vs resellers, Amazon tends to push all to FBA. While it may be worthwhile, it also created potential issues with commingling inventory and allowing Amazon to inspect and repackage your returns for resale.

What’s your top tip for someone who is just starting to sell on Amazon and someone who is trading for a few years?

Do not solely focus on the Amazon platform. Diversify your eCommerce presence and look to build your own website if you are launching your own brand.
